A final legal appeal by nine area landowners challenging the validity of New Jersey's 2004 Highlands Act was rejected by the U.S. Supreme Court June 28, the Highlands Council announced Wednesday. The nation's highest court was the last recourse for the landowners from Warren, Hunterdon and Morris counties. The law was enacted to protect freshwater resources across more than 800,000 acres in seven northern New Jersey counties by placing development restrictions on the land. The landowners had argued the Highlands Act was unconstitutional, but were defeated in each level of state court over the last two years.
